4. Scheduling and Project Timelines
- Project timelines are estimates only
- Scheduling may be affected by:
- Weather conditions

- Site readiness
Masterset Concrete is not liable for delays outside of its control.
5. Payments
- Payment terms will be defined in your project agreement
- Deposits may be required before scheduling
- Late payments may result in:
- Work suspension
- Additional fees
- Collection actions
Masterset Concrete reserves the right to suspend work for non-payment or breach of agreement.
6. Cancellations and Refunds
- Cancellations must be submitted in writing
- Deposits may be non-refundable depending on the project stage
- Work completed or materials ordered are non-refundable
7. Customer Responsibilities
You agree to:
- Provide accurate and complete project information
- Ensure job site access and readiness
- Remove obstacles, hazards, and obstructions before work
- Obtain necessary permits unless otherwise agreed
Failure to meet these conditions may result in delays, additional costs, or rescheduling.
8. Site Conditions and Unknown Factors
Masterset Concrete is not responsible for unknown, concealed, or unforeseen site conditions, including but not limited to:
- Subsurface conditions or unstable soils
- Buried debris, utilities, or obstructions
- Improper prior construction or base preparation
- Drainage or grading deficiencies
Discovery of such conditions may require additional work, cost, and time.
9. Concrete Material Disclaimer
Concrete is a natural material and subject to inherent characteristics, including but not limited to:
- Cracking
- Shrinkage
- Surface variations
- Color and texture differences
Cracking cannot be completely prevented and is not considered a defect.
Control joints are placed for structural performance and may not align with aesthetic preferences.
10. Weather, Cure Time, and Use Restrictions
Concrete installation and performance are highly dependent on environmental conditions.
- Work may be delayed or rescheduled due to weather
- Client must follow all cure-time and usage instructions
Masterset Concrete is not responsible for damage caused by:
- Premature use
- Weather exposure after installation
- De-icing chemicals or freeze-thaw cycles
11. Drainage and Water Disclaimer
Client acknowledges that concrete work may affect water flow and drainage patterns.
Masterset Concrete does not guarantee elimination of:
- Standing water
- Runoff issues
- Drainage-related conditions
Unless explicitly agreed in writing.
12. Change Orders
Any changes to the project scope must be approved in writing before execution.
Changes may result in:
- Additional costs
- Revised timelines
Verbal requests or approvals are not enforceable.
13. Clawback and Cost Recovery
Masterset Concrete reserves the right to recover costs (“clawback”) for work performed, materials procured, and resources allocated due to project disruption or client-related delays.
This includes:
- Cancellation after scheduling or material procurement
- Failure to provide site access
- Project delays caused by the client
- Non-payment or breach
Masterset Concrete may:
- Retain deposits
- Invoice for completed or committed work
- Recover labor, materials, mobilization, and administrative costs
All such amounts are immediately due.
14. Mechanic’s Lien Rights
Masterset Concrete reserves the right to file a mechanic’s lien in accordance with applicable laws in Minnesota and Wisconsin for unpaid balances.
15. Force Majeure
Masterset Concrete shall not be liable for delays or failure to perform due to events beyond its control, including but not limited to:
- Weather conditions (rain, snow, freezing temperatures, extreme heat)
- Natural disasters
- Labor or material shortages
- Government actions or permit delays
- Utility disruptions
- Acts of war or civil unrest
Project timelines will be extended as necessary. No penalties or damages shall apply.
16. Limitation of Liability
To the fullest extent permitted by law:
- Masterset Concrete is not liable for indirect, incidental, or consequential damages
- Total liability is limited to the amount paid for services
17. Dispute Resolution
Parties agree to attempt resolution through good-faith negotiation and mediation prior to initiating legal action.
18. Attorney’s Fees
In any dispute arising from services or agreements, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
19. Intellectual Property
All content on this Site (text, images, branding, logos) is owned by Masterset Concrete and may not be used without written permission.
20. Marketing and Media Release
Masterset Concrete reserves the right to photograph, video, and document completed work for marketing and portfolio purposes unless otherwise agreed in writing.
21. Governing Law
The laws of the States of Minnesota and Wisconsin govern these Terms.
22. Supremacy of Written Agreements
In the event of any conflict between these Terms and a signed project agreement, the signed agreement shall control.
23. Changes to Terms
We may update these Terms at any time. Updates will be posted with a revised effective date.
